Terms of Business — Families

These Terms of Business set out the agreement between Cura Nidus (“the Agency”, “we”, “us”) and the Client (“you”, “the family”) for the introduction of childcare candidates (“the nanny”).
By engaging our services or making an enquiry, you agree to these terms.
1. Our Role
Cura Nidus acts solely as an introducer between families and childcare professionals.
We do not employ nannies, and we are not a party to any employment agreement formed between a family and a nanny.
All employment arrangements, contracts, and payments are made directly between you and your chosen nanny.
2. Our Service
We provide an introduction service which includes:
- An initial consultation to understand your childcare needs
- Advertising and candidate search
- Screening, vetting, and shortlisting suitable candidates
- Arranging introductions and interviews
We aim to match families with experienced, trustworthy nannies who meet our safeguarding standards.
3. Fees and Payment
Our finder’s fee is a one-off charge of 10% of your nanny’s agreed annual gross salary.
Example:
If a nanny’s annual salary is £30,000, the finder’s fee will be £3,000.
- The fee is payable once your chosen nanny accepts your offer of employment.
- An invoice will be issued and is payable within 7 calendar days of the nanny’s acceptance.
- Fees are non-refundable except as set out in our replacement policy (Section 4).
No introduction should be accepted unless you agree to these terms.
4. Replacement Policy
If your nanny leaves or employment is terminated within four (4) weeks of their start date, Cura Nidus will provide a replacement introduction at 50% of the original finder’s fee, provided:
- The original finder’s fee has been paid in full and on time.
- The departure was not due to unreasonable working conditions, breach of contract, or relocation by the family.
We will begin a replacement search as soon as possible. If no suitable candidate is found within 8 weeks, no further refund or replacement will be offered.
5. Candidate Information
All candidate information provided by Cura Nidus — including CVs, references, and contact details — is confidential and supplied for your use only.
You agree not to share, disclose, or pass this information to any third party.
If you introduce a Cura Nidus candidate to another family or employer, and that introduction results in employment, our standard 10% fee will still apply.
6. Safeguarding and Vetting
All candidates are required to:
- Hold a valid Enhanced DBS check
- Provide verified childcare references
- Confirm their right to work in the UK
While we take reasonable steps to verify information, Cura Nidus cannot guarantee the accuracy of references, background checks, or DBS information supplied by third parties.
7. Limitation of Liability
Cura Nidus accepts no responsibility for any loss, damage, or injury arising from the employment or actions of a nanny introduced through our service.
You are advised to make your own assessments and employment checks as appropriate.
We recommend all families issue written employment contracts and maintain adequate home and employer’s liability insurance.
8. Data Protection
Cura Nidus complies with the UK GDPR and the Data Protection Act 2018.
All personal data is handled in accordance with our [Privacy Policy].
9. Governing Law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the English courts.
10. Acceptance
By requesting or accepting candidate introductions, you acknowledge that you have read, understood, and agreed to these Terms of Business.
